DUI (Driving Under the Influence) risk classifications is a system used to assess and categorize individuals based on their risk levels related to alcohol or drug-related driving offenses. These classifications help legal authorities, such as courts and probation departments, make informed decisions regarding sentencing, probation requirements, and treatment recommendations. Illinois law requires that every individual arrested for driving under the influence in the State of Illinois to complete a court ordered DUI Evaluation prior to his or her DUI sentencing. The purpose of your DUI Evaluation is to determine the extent of your alcohol and/or drug use, including your risk to public safety. Such determination is made by a licensed DUI Evaluator assessing your past and present use of substances, including the DUI Evaluator reviewing your driving record. The State of Illinois has reserved Risk Classifications for DUI offenders based on their past/present use of substances, results or refusal of chemical testing, and history of prior DUI arrests. An offender’s assigned Risk Classification is provided to the adjudicating court through the offender’s completed DUI Evaluation. 

DUI RISK ASSESMENT CLASSIFICATION LEVELS

Minimal Risk

Individuals classified as low-risk DUI offenders typically have a relatively minor first-time offense with a low blood alcohol concentration (BAC). They may not have a history of substance abuse or other criminal offenses. Low-risk offenders may be subject to less severe penalties and may not require intensive treatment or supervision.

Moderate Risk

  • Minimum ten hours of DUI risk education

  • Minimum of 12 hours of early intervention- over a minimum of four weeks with no more than three hours per day in any seven consecutive days

  • Subsequent completion of any and all necessary treatment

Moderate-risk DUI offenders have a more significant offense or may have prior DUI convictions. Their BAC levels may be higher, and they may show signs of problematic drinking or drug use. They may be required to attend DUI education programs, undergo substance abuse evaluations, and comply with stricter probation conditions.

A "significant risk DUI offender" refers to an individual who, due to a history of multiple DUI (Driving Under the Influence) convictions, high blood alcohol concentration levels, aggravated circumstances such as accidents or aggressive behavior during arrests, and possibly underlying substance abuse issues, poses a substantial and heightened risk to public safety, warranting stricter legal penalties and interventions to reduce the likelihood of further impaired driving incidents.

High-risk DUI offenders are individuals with multiple DUI convictions, high BAC levels, a history of substance abuse, or other aggravating factors. They pose a substantial risk to public safety. Courts often impose more severe penalties, including longer license suspension, mandatory rehabilitation programs, ignition interlock device installation, and probation with stricter monitoring.
